➤ CHARGE POLICY IN THE CASE OF A FORCE MAJEURE EVENT
Force majeure
- According to Article 156 of Vietnam’s Civil Code 2015, a force majeure event is an event that occurs objectively, which cannot be foreseen and cannot be remedied, despite the application of all necessary measures and the ability to do so. Accordingly, the force majeure event is understood and agreed by the parties (school and parents/guardians) including, but not limited to, any fire, natural disaster, storm, earthquake, war, government action, terrorist act, epidemic, pandemic, or any other event beyond the control of the School that prevents the School from carrying out educational activities on campus during the force majeure events. Evacuations and the stopping/pausing of related operations ordered by the Vietnamese government/authorities due to the anticipation of a force majeure also apply to this policy whether or not the force majeure actually occurs.
• Parents/guardians understand and agree that, if an event of force majeure (as defined above) occurs, the School reserves the right to proactively alter and/or adjust the curriculum, study time and learning formats appropriate to the context of the time while maintaining its commitments to the program completion and minimizing disruptions in student learning activities. These measures taken by the School will comply with the regulations and guidance of the State management units under the Ministry of Education and Training (MoET), the Ministry of Health (MoH) and the relevant authorities at the time of the occurrence of force majeure circumstance.
Charge policy
- Parents are responsible for the full tuition fees and other fees for the school year to ensure the completion of the academic program. In addition, the School will partially or entirely refund paid tuition fees and other fees depending on the duration of the force majeure events and the arising consequences. This policy is deemed necessary to ensure the financial and operational stability of the School during an event of force majeure and its continued operations subsequent to any such event.
- Study time affected by force majeure may be compensated by prolonging the school year according to the actual conditions at that time. This measure will be implemented in the event that the School Management Board deems it necessary to ensure that educational objectives of SY 2023-2024 will not be compromised, after ensuring that the extension of the school year is feasible and that the terms of commitments in the contract between the School and the teachers/staff are not contravened.
- In the event that it is not feasible to arrange onsite learning to compensate for the period affected by force majeure events, the School will apply the distance/online learning fee refund policy SY 2023-2024 as follows:
➤ Tuition
Grade | Fee refund for Distance/Online Learning period | ||

- The enactment of UTS’s force majeure policy, in accordance with the foregoing provisions, will nullify other policies regarding fee refunds unless Parents have formally requested the student’s withdrawal from UTS prior to the School’s notice of force majeure event.
